Draft Guidelines for Vitamin and Mineral Food Supplements
(at Step 8 of the Procedure)

PREAMBLE

Most people who have access to a balanced diet can usually obtain all the nutrients they require from their normal diet. Because foods contain many substances that promote health, people should therefore by encouraged to select a balanced diet from food before considering any vitamin and mineral supplement. In cases where the intake from the diet is insufficient or where consumers consider their diet requires supplementation, vitamin and mineral food supplements serve to supplement the daily diet.

1. SCOPE

1.1 These guidelines apply to vitamin and mineral food supplements intended for use in supplementing the daily diet with vitamins and/or minerals.

1.2 Food supplements containing vitamins and/or minerals as well as other ingredients should also be in conformity with the specific rules on vitamins and minerals laid down in these Guidelines.

1.3. These Guidelines apply in those jurisdictions where products defined in 2.1 are regulated as foods.

1.4. Foods for special dietary uses as defined in the General Standard for the Labelling of and Claims for Prepackaged Foods for Special Dietary Uses (CODEX STAN 146-1985) are not covered by these Guidelines.

2. DEFINITIONS

2.1 Vitamin and mineral food supplements for the purpose of these guidelines derive their nutritional relevance primarily from the minerals and/or vitamins they contain. Vitamin and mineral food supplements are sources of concentrated forms of those nutrients alone or in combinations, marketed in forms such as capsules, tablets, powders, solutions, etc.,that are designed to be taken in measured small-unit quantities 1 but are not in a conventional food form and whose purpose is to supplement the intake of vitamins and/or minerals from the normal diet.

3. COMPOSITION

3.1 Selection of vitamins and minerals

3.1.1. Vitamin and mineral food supplements should contain vitamins/provitamins and minerals whose nutritional value for human beings has been proven by scientific data and whose status as vitamins and minerals is recognized by FAO and WHO.

3.1.2. The sources of vitamins and minerals may be either natural or synthetic and their selection should be based on considerations such as safety and bioavailability. In addition, purity criteria should take into account FAO/WHO standards, or if FAO/WHO standards are not available, international Pharmacopoeias or recognized international standards. In the absence of criteria from these sources, national legislation may be used.

3.1.3 Vitamin and mineral food supplements may contain all vitamins and minerals that comply with the criteria in 3.1.1. a single and/or mineral or an appropriate combination of vitamins and/or minerals.

3.2 Contents of vitamins and minerals

3.2.1 The minimum level of each vitamin and/or mineral contained in a vitamin and mineral food supplement per daily portion of consumption as suggested by the manufacturer should be 15% of the recommended daily intake as determined by FAO/WHO.

3.2.2 Maximum amounts of vitamins and minerals in vitamin and mineral food supplements per daily portion of consumption as recommended by the manufacturer shall be set, taking the following criteria into account:

(a) upper safe levels of vitamins and mineral established by scientific risk assessment based on generally accepted scientific data, taking into consideration, as appropriate, the varying degrees of sensitivity of different consumer groups;

(b) the daily intake of vitamins and minerals from other dietary sources.

When the maximum levels are set, due account may be taken of the reference intake values of vitamins and minerals for the population. This provision should not lead to setting of maximum levels that are solely based on recommended nutritient intakes (e.g. Population Reference Intake or Recommended Daily Allowance values).

4. PACKAGING

4.1 The product shall be packed in containers which will safeguard the hygienic and other qualities of the food.

4.2. The containers, including packaging material, shall be made only of substances which are safe and suitable for their intended use. Where the Codex Alimentarius Commission has established a standard for any substance used as packaging material, that standard shall apply.

5. LABELLING

5.1 Vitamin and mineral food supplements should be labelled according to the Codex Standard for the Labelling of Prepackaged Foods (Codex-Stan 1-1985 Rev. 1-1991) as well as according to the General Guidelines on Claims (CAC/GL 1-1979).

5.2 The name of the product shall be "food supplement" with an indication of the category(ies) of nutrients or of the individual vitamin(s) and/or mineral(s) contained in the product as the case may be.

5.3 The amount of the vitamins and minerals present in the product should be declared in the labelling in numerical form. The units to be used should be units of weight consistent with the Codex Guidelines on Nutrition Labelling.

5.4 The amounts of the vitamins and minerals declared should be those per portion of the product as recommended for daily consumption and if different, the amount per unit for single use may also be given.

5.5 Information on vitamins and minerals should also be expressed as a percentage of the nutrient reference values mentioned, as the case may be, in the Codex Guidelines on Nutrition Labelling.

5.6 The label should indicate how the product should be used (quantity, frequency, special conditions).

5.7 The label shall contain advice to the consumer not to exceed the maximum one-day amount.

5.8 The label should not state or imply that supplements can be used for the replacement of meals or a varied diet.

5.9 The label shall contain a statement that the product should be stored out of the reach of young children.

Health Freedom to End Soon

Health Freedom to End in August 2005???

Something is happening in virtual secrecy that may have an adverse affect on all of us.

The CODEX ALIMENTARIUS (Food Code) is setting the supplement standards for the countries in the WTO, which includes the United States.The CODEX rules are intended to be enforced by the WTO and to override individual member nation laws. The U.S. President and Congress agreed to this take-over when the WTO Treaty was signed.

CODEX drastically restricts vitamins, minerals, herbs and other supplements. CODEX met secretly in November, 2004 and finalized "Step 8 (the final stage)" to begin implementation in June 2005.

Virtually nothing about it has been in the media. What the drug corporations have failed to do through Congress they may get by sneak attack through CODEX with the help of a silent media.

The CODEX says, among other things:

(1) No supplements can be sold for preventative or therapeutic use.

(2} Any potency higher than RDA (minimal strength) is a drug requiring a prescription and must be produced by drug companies. Over 5000 safe items now in health stores will be banned, terminating health stores as we now know them.

(3) CODEX regulations become binding internationally.

(4) New supplements are banned unless given very expensive CODEX testing and approval.

In Norway and Germany, where CODEX is now implemented, zinc tablets rose from $4 per bottle to $52, Echinacearose from $14 to $153 and both are now available by prescription only. They are now called "drugs". Vitamin C above 200 mg; niacin above 32 mg; vitamin B6 above 4 mg are all banned.In addition, amino acids (arginine, lysine, carnitine, etc. ); essential fatty acids (omegas 3, 6, 9, etc.), or other essential supplements such as DHEA, CoQlO, MSM, beta-carotene, etc, are not allowed.

The CODEX rules are not based on any real science or research. They are made by a few people meeting in secret. In 1993 the FDA and drug corporations tried to put all supplements under restriction and prescription. But over 4 million Americans told Congress and the President to protect their freedom of choice on health supplements. The DSHEA Law was passed in 1994, which protected our freedom. But this will be over ruled by CODEX and the World Health Organization.

Is this real?

With WTO secrecy, no media attention, confusion and uncertainty among supplement companies and public officials,and support by the FDA and pharmaceutical lobby, uncertainty prevails.It appears, based on my limited understanding, that the US Congress has to pass legislation to require CODEX implementation in the United States before this can take effect.The August implementation is for the European Union.But, there is legislation in the US House and Senate to make this the law of our land as well.

What Can We do?

First, we need to be as well informed as possible, especially given the secrecy in which this is being handled.

Second, we all need to contact our congressmen and senators to make sure that they are informed about what is happening and that we, the voters, don't want it.

Oppose bills S.722 and H.R.3377. (These bills support the CODEX restrictions with US laws, changing the DSHEA law that we fought so hard for.)

Express your wishes to the President, Senators and Representatives ASAP. (They got us into this!)

Working stealthily BIG PHARMA has rapidly pushed their legislative program (Codex Alimentaris) in Europe that will eliminate the free choice Americans now have to purchase vitamins, herbs, minerals, homeopathic remedies, aminoacids and nutritional supplements. This elimination of all competition for the pharmaceutical industry will produce an enormous increase in the already exorbitant profits earned by the pharmaceutical firms. Of even greater significance the lack of free choice to stay well by taking effective nutritional substances will promptly be followed by a sharp increase in illnesses that will only be treated in the future with pharmaceutical drugs.

The new Codex Alimentaris adopted in a secret meeting in Europe in November 2004 is scheduled to take effect in June 2005. Because the United States belongs to the World Trade Organization WTO any changes approved in Europe automatically become law in the United States superceding our own laws (we are no longer a sovereign nation). Failure to comply with these changes institutes lawsuits which can not be won as they are settled in international courts which care nothing about U.S. laws. Incidentally, Europe has been very leery of genetically modified foods because of serious concerns about their safety. By this same WTO mechanism Europe will be forced to accept importation of U.S. GMO foods even if they know they are bad for health.

The features of Codex Alimentaris are:

No supplements can be sold for preventative or therapeutic use.

Any potency higher than RDA levels (pathetically low) is a drug that requires a prescription and must be produced by drug companies.

Codex regulations are binding internationally

New supplements are banned unless given Codex testing and approval (certain to expensive and lacking in scientific merit). Norway and Germany are already operating under the new Codex regulations. The price of zinc tablets has gone from $4 to $52. Echinacea has risen from $14 to $153.

Codex regulations are not based on science or research findings. These regulations were developed by 11 appointed persons. Guess who appointed them?

Why Haven't I Heard About This?

The controlled press has been instructed to avoid commenting on this issue until it becomes a fait accomplis. At that time your congressional legislators will say they are sorry but there is nothing they can do to reverse the Codex. The truth is they were, all but a few, bought and paid for back when the World Trade Organization was ratified by the U.S. Congress.

Can Anything Be Done To Stop This Codex?

I hope so but the remaining time is miniscule and the enemy has carried out a brilliant strategy. There is no reason for any optimism about the possibility of reversing the Codex regulations. A brilliant English lawyer (Anderson), considered to be the top lawyer in that nation, has agreed to fight the Codex in court because he thinks he can win. This fight needs money because it is against the incredible financial resources of the pharmaceutical industry. Two other sinister Directives need to be reversed in Brussels as well as the implemented Codex Directive. Donations to the http://alliance-natural-health.org are vital. These funds will be used to try to overturn Codex and hire lobbyists to oppose the other 2 Directives.

Contacting your congressman and senator is desirable. If millions of persons get involved the legislators may take notice. The New World Order leaders were shocked when meetings in Seattle in 1999 and Quebec City in 2001 resulted in riots. When the responsible U.S. citizens that have kept themselves well with intelligent use of supplements learn that there is nothing available from now on they are likely to be very angry. For many persons this may crystallize the realization that they are living in a police state and that there is no longer any power in the hands of private citizens.

What Can Concerned Individuals Do To Preserve Good Health?

If our donations do not stop this pharmaceutical juggernaut some planning may still be worthwhile. Many large natural health product providers seem to be oblivious to this danger. Perhaps they are planning on selling out to BIG PHARMA at the last minute.

Buying a stock of the supplements that have helped you seems wise. Remember the expiration date on a bottle is simply an educated guess. Manufacturers want to error on the side of public safety and setting dates close to the time of manufacture encourages increased sales volume. The U.S. military has taken advantage of the probable safety of medicines beyond their expiration date by continuing to use expired bottles for many months beyond their expiration date. This program has saved the military many millions of dollars in pharmaceutical costs. To determine safety of products involves expensive testing for evidence of oxidation and other deterioration of products so it is not done very frequently by most companies.

Essential oils are very potent substances carefully grown and distilled from flowers, trees, shrubs, plants, flowers, roots, herbs, bushes and seeds. Responses to Questions about Codex and Dietary Supplements

Many U.S. consumers have expressed concerns about the development of the Codex Draft Guidelines for Vitamin and Mineral Food Supplements. Some are concerned that these Guidelines, if adopted by Codex, will restrict consumers' access to the wide range of vitamin and mineral supplements of varying potencies legally sold in the United States. Others are concerned that the Guidelines will limit the amount and type of information on the labels of dietary supplements sold in the United States. What is Codex?

The Codex Alimentarius Commission, or Codex, was created in 1963 by two U.N. organizations, the Food and Agriculture Organization and the World Health Organization. Its main purpose is to protect the health of consumers and to ensure fair practices in international trade in food through the development of food standards, codes of practice, guidelines and other recommendations. Codex standards and guidelines are developed by committees, which are open to all member countries. Member countries review and provide comments on Codex standards and related texts at several stages in the development process. In the United States, public meetings are held to receive comments on Codex drafts and comments are invited from all interested parties (See U.S. Codex Office web site). Codex standards and related texts are voluntary; member countries are not bound by or required to adopt them.

What work has Codex undertaken on vitamin and mineral supplements?

In the early 1990's, the Codex Committee on Nutrition and Foods for Special Dietary Uses (CCNFSDU) began discussions on guidelines for vitamin and mineral supplements. This Committee is responsible for studying nutritional issues referred by the Codex Alimentarius Commission; drafting provisions, as appropriate, on the nutritional aspects of all foods; and developing standards, guidelines, or related texts for foods for special dietary uses. Germany is the host government for the Committee, which has met either every year or every other year since 1966.

At its most recent session (Bonn, November 1-5, 2004), the Committee completed work on Draft Guidelines for Vitamin and Mineral Food Supplements and submitted them for adoption by the Codex Alimentarius Commission at the Commission's July 2005 meeting.

What is the scope and content of these Guidelines?

The Guidelines apply only to supplements that contain vitamins and/or minerals, where these products are regulated as foods.

The Guidelines address the composition of vitamin and mineral supplements, including the safety, purity, and bioavailability of the sources of vitamins and minerals.

The Guidelines do not specify upper limits for vitamins and minerals in supplements. Instead, they provide criteria for establishing maximum amounts of vitamins and minerals per daily portion of supplement consumed, as recommended by the manufacturer. The criteria specify that maximum amounts should be established by scientific risk assessment based on generally accepted scientific data and taking into consideration, as appropriate, the varying degrees of sensitivity of different consumer groups.

The Guidelines also address the packaging and labeling of vitamin and mineral supplements.

What has been the U.S. position on these Guidelines?

The U.S. supports consumer choice and access to dietary supplements that are safe and labeled in a truthful and non-misleading manner. The Dietary Supplement Health and Education Act of 1994 (DSHEA) ensures that a broad array of dietary supplements are available to U.S. consumers. The Codex Guidelines for Vitamin and Mineral Food Supplements will not, in any way, affect the availability of supplement products to U.S. consumers. On the contrary, the absence of science-based Codex guidelines could adversely affect the ability of U.S. manufacturers to compete in the international marketplace.

Why won't these Guidelines restrict U.S. consumers' access to vitamin and mineral supplements?

Some consumers mistakenly believe that if Codex should adopt guidelines on vitamin and mineral food supplements that are more restrictive than DSHEA, the U.S. would be required to automatically change its laws and regulations to comply with the international standard. Some consumers have expressed concerns that the World Trade Organization (WTO) and its trade dispute settlement panels may place pressure on the U.S. to change its laws because of international trade agreements such as the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement), which references Codex as the international organization for food safety standards.

We see no basis for these concerns. First, the DSHEA covers a much broader range of dietary supplements than the vitamin and mineral supplements that are the subject of the Codex Guidelines. Moreover, for supplements covered by these Guidelines, we note the following:

* The SPS Agreement does not require a country to adopt any international standard. Rather, the SPS Agreement provides that members may base their Sanitary and Phytosanitary measures either on international standards, guidelines or recommendations, where they exist, or may establish measures that result in a higher level of protection if there is a scientific justification, or if a country determines it to be appropriate in accord with provisions of the SPS Agreement (SPS Agreement, Article 3(1) and (3)).

* WTO and WTO dispute panels do not have the power to change U.S. law. If a WTO decision in response to a dispute settlement panel is adverse to the U.S., only Congress and the Administration can decide whether to implement the panel recommendation, and, if so, how to implement it.

* For dietary supplements, it is unlikely that another country will accuse the U.S. of imposing a trade barrier for the importation of supplement products into the U.S. marketplace because the U.S. laws and regulations are generally broader in scope and less restrictive than the international standard.

* However, other countries with more restrictive laws and regulations for dietary supplement products than the U.S. may create trade barriers to the importation of products manufactured by the U.S. dietary supplement industry. Thus, the U.S. government's involvement in the setting of international standards can help minimize the potential of trade barriers to U.S products in international trade.

Further, there is no basis for the concern that the Codex Guidelines on Vitamin and Mineral Food Supplements would require dietary supplements be sold as prescription drugs in the United States. First, there is nothing in the Guidelines that suggests that supplements be sold as drugs requiring a prescription. Second, U.S. regulatory agencies are bound by the laws established by Congress, not by Codex standards. Third, because of our generally less restrictive standards, it is unlikely that the trade dispute would be brought against the U.S.

In summary, U.S. consumers' access to a broad array of dietary supplements under DSHEA would not be changed in any way by Codex's adoption of guidelines on vitamin and mineral food supplements.

The Guidelines also include packaging and labeling provisions for vitamin and mineral food supplement products. Would vitamin and mineral supplements sold in the U.S. be required to comply with these?

All Codex standards and related texts are voluntary, and vitamin and mineral food supplement products sold in the U.S. would not be required to comply with provisions that are more restrictive than U.S. law (i.e., DSHEA).

If the U.S. is not trying to harmonize its regulatory framework for dietary supplements with Codex, what are the benefits of our country participating in the process of developing these Codex Guidelines?

Our participation in the Codex process is important to encourage the development of guidelines on vitamin and mineral supplements that are based on sound science and not on arbitrary criteria. For example, encouraging the use of science-based risk assessment for determining the maximum levels of vitamins and minerals in supplements reduces the chance that arbitrary standards will be used for determining maximum levels.

How can I keep abreast of the work of Codex?

To keep abreast of U.S. Codex activities, you may want to periodically access the U.S. Codex Office website.

You can also obtain the agenda and reference documents for Commission and committee meetings and final reports from these meetings from the Rome Codex website.

The appendices to the committee reports provide the latest draft versions following a committee meeting of some of the Codex standards that are being developed or revised by the Committee.

The Codex Alimentarius Commission was created in 1963 by FAO and WHO to develop food standards, guidelines and related texts such as codes of practice under the Joint FAO/WHO Food Standards Programme. The main purposes of this Programme are protecting health of the consumers and ensuring fair trade practices in the food trade, and promoting coordination of all food standards work undertaken by international governmental and non-governmental organizations.
